Why this John Bolton Case Stands Apart Significantly from Additional Former President Opponents

Former President Donald Trump has consistently expressed his desire to see opponents investigated, applying pressure on the Justice Department to prosecute former FBI Director James Comey and New York Attorney General Letitia James.

But the latest charges against a Trump critic, former security advisor John Bolton, stand apart, legal experts and ex-prosecutors assert.

"In my opinion, contrasting Bolton's charges to Comey's is like comparing two different things," said Mark Lesko, a former acting US attorney for the Eastern District of New York.

The Specifics of Bolton's Legal Situation

Bolton has been criminally indicted on national allegations pertaining to the alleged improper handling of classified information. After leaving the White House in 2019, he has emerged as a vocal Trump critic, even to describe him "stunningly uninformed" and unsuitable for office in his book.

Specialists say that while there may be political motivations to target Bolton, the procedures used to obtain an charge and the evidence compiled against him indicate a possibly more substantial case than the Justice Department presented against James.

"This misconduct that's being claimed is both more severe and seems to have occurred over a significant duration," said Carissa Byrne Hessick, a professor at the University of North Carolina School of Law.

During his tenure as Trump's national security adviser, and after his 2019 White House exit, prosecutors alleged that Bolton put the nation at risk by wrongfully retaining and sending classified information to family members using insecure means, including AOL. Several of the documents were labeled top secret.

Charging such a high-ranking official for improperly handling sensitive materials is "rare" but not unprecedented, noted Carrie Cordero, a senior fellow at the Center for a New American Security.

"Situations that involve sensitive materials present challenges to try, but they may and are filed against equally junior and senior officials, from occasionally," she said.

Similarities to Examinations into Former President and Biden

Trump similarly faced allegations of improperly keeping classified documents at his Mar-a-Lago property in Florida and obstructing their recovery, but that matter was ultimately thrown out by a court official and voided by his return as leader.

A special counsel also determined that former President Joe Biden wrongfully maintained classified documents from his time as vice president, but failed to prosecute him.

Bolton's situation bears similarities to Biden's classified documents issues, said Mr Lesko, who previously held a senior national security role at the Justice Department.

Rigorous protocols regulate the management of sensitive materials. To secure a conviction, the government must demonstrate that Bolton was aware the material he was transmitting was classified, and he had to intentionally transmit it to someone not entitled to obtain it.

"Because of the classified character of the information at issue in this case, we don't have a lot of details about why the government contends things like the diary entries and the additional material he shared by electronic message, and why there were restricted," explained Mr Jaffer.

A Increasingly Conventional Prosecution

The procedure by which the Justice Department initiated this legal action will be under scrutiny, following Trump publicly expressed his wish to see his political opponents prosecuted and several of those charges came to fruition.

But Mr Lesko said in Bolton's case, prosecutors seem to have adhered to protocol.

"This Bolton case and ultimately the indictment seemed to have observed the regular procedure including the rules and norms within the DOJ," he stated.

Unlike Comey's brief, concise indictment, Bolton's was a increasingly "conventional" filing that "clearly sets forth the particulars concerning the circumstances and situation here," Mr Lesko said.

"It appears reasonably aligned with a series of precedents... where government officials improperly handled and shared sensitive information."
